Waste Collection Permit
A Waste Collection Permit is issued to a person/company to collect waste subject to conditions.
A person can not collect waste for the purposes of reward/profit without a valid Waste Collection Permit.
In the case of a multi-regional Permit the holder is permitted to transport and collect waste within the local authority area(s) permitted.
From the 1st February 2012, all new waste collection permit applications and applications for the review of waste collection permits, shall be processed by the National Waste Collection Permit Office (NWCPO), Offaly County Council, Aras an Chontae, Charleville Road, Tullamore, Co. Who needs a Waste Collection Permit
Anybody, other than a local authority, who collects waste for the purposes of profit or reward, is required to hold a Waste Collection Permit. Please see below for exceptions from this requirement to hold a Waste Collection Permit.
Exemptions for holding a Waste Collection Permit
There are a number of instances where a Waste Collection Permit is not required, for a more detailed answer please refer to the Waste Management (Collection permit) Regulations 2007. In brief, the exemptions include these include:
- The gathering, sorting or mixing of waste on the premises at which the waste arose.
- The gathering, sorting or mixing of waste which is carried on in accordance with a waste licence, IPPC licence, facility permit or certificate of registration.
- The collection and transportation of non-hazardous waste that is incidental to a persons main business activity and where the quantity is less than or equal to 2 tonnes.
- The collection and transportation of waste, returned or recovered refrigerant gases in refrigerant containers subject to certain conditions.
- The collection and transportation of waste, returned or recovered halons in halon containers subject to certain conditions.
- The collection and transportation of waste, returned or recovered fluorinated greenhouse gases in fluorinated greenhouse gas containers subject to certain conditions.
- The collection and transportation of animal by-products other than catering waste.
- The collection and transportation of packaging waste by a major producer.
- The collection and transportation of farm plastic waste by a producer.
- The collection of waste at a bring facility.
- The collection and transport of WEEE subject to certain conditions.
- The collection and transport of waste by a charity that has been granted a CHY number by the revenue commissioners.
- The collection of waste from a central point by a local authority or with the permission of a local authority.
Please note that there are conditions attached to many of these exemption, check the Regulations before collecting or transporting any waste material.

Registered Charity
Charities that have been granted charitable recognition by the Revenue Commissioners and have a Charity (CHY) Number do not need a Waste Collection Permit.
The waste must not be collected or transported in a vehicle designed to carry a skip or other demountable container and in the case of the charitable collection of waste electrical and electronic equipment (WEEE) that the collection does not include lighting equipment.
Cost of a Waste Collection Permit
Single-region permit fee is €1000
Multi-region permit fee is €1000 per region up to a maximum charge of €5000 for all Regions.
Lifetime of a Waste Collection Permit
A permit is granted for a period of five years. It will expire after the five year period if a review is not initiated within the five year period at least 60 days before the expiry date.
EWC (European Waste Catalogue) Code
An EWC Code is a code used to describe a waste type taken from the European Waste Catalogue and Hazardous Waste List. The different types of waste in the list are fully defined by the six-digit code for the waste and the corresponding waste description. The list is available to download from http://www.epa.ie
Licenced/Permitted Waste Facility
A facility is a site/premises used for the recovery/disposal of waste.
A Licenced/Permitted waste facility is must have a Waste Permit issued by a local authority or a Waste Licence issued by the Environmental Protection Agency.
Waste Facility Permit
The Council issue waste permits for waste recovery activities in county Westmeath.
These activities include:
- The deposition of soil and stones to raise a site or improve agricultural benefit of the land
- Recycling/Sorting centres
- Car Dismantling Facilities
It is an offence to deposit waste in a facility that does not have a Waste Permit/Cert of Registration or a Waste Licence.

What are the E.L.V.s Regulations?
The Waste Management (End-of-Life Vehicles or ELV) Regulations 2006 came into effect on the 8th of June 2006 in an effort to make car manufacturers responsible for vehicles they put on the market. These vehicles pose a huge waste problem when they are no longer wanted or used. These E.L.V.s Regulations were brought in as part of a European Directive (2000/53/EC).
Obligation on Car Distributors:
The Regulations require any car manufacturer in Ireland (subject to conditions) to set up a network of Authorised Treatment Facilities (A.T.F.s) where people can bring their unwanted vehicles free of charge.
Obligation on Authorised Treatment Facilities (A.T.F.s):
A.T.F.s are obliged to take in vehicles free of charge. A small charge can be imposed if it is missing any essential components (i.e. wheels, engine, coachwork, catalytic converter) or has added waste. The A.T.F. is then required to depollute (remove all hazardous materials) and dismantle the vehicle. A Certificate of Destruction is issued to the registered owner of the vehicle.
Obligation on Registered Car Owner:
All Registered Owners of vehicles are now obliged to dispose of their vehicle through an A.T.F. You should only deal with a properly permitted authorised treatment facility when getting rid of your old vehicle as these are the only ones that can issue Certificates of Destruction. The A.T.F shall notify the Vehicle Registration Unit of the Department of the Environment, Heritage and Local Government in Shannon, Co. Clare and the destruction of your vehicle will be noted in the records of the National Vehicle File. The only document you need to give the facility is the Vehicle Registration Certificate (RF101) or the log book for the car.

Please note that the collecting vehicle must have a valid Waste Collection Permit to deposit an E.L.V at an A.T.F.
Movement of hazardous waste
A system of consignment notes (C1 Forms) are used to track and monitor the movement of hazardous waste within the State. C1 Forms must be completed for every consignment of hazardous waste other than the movement of waste within the premises where it is produced, stored, treated or deposited.
Illegal burning of waste
The disposal of waste (household and commercial waste) by uncontrolled burning/backyard burning is an offence.
An exemption is provided for farmers, under specific circumstances, until 1st January 2014. After this date all such activities will require registration and permits.
Waste tyres
There are obligations on persons who supply tyres whether as manufactures, wholesalers, suppliers, traders, or retailers and on the collectors of waste tyres.
An exemption from these obligations is available to persons who participate in either of the following collective compliance scheme:

2. TWM (Tyre Waste Management) compliance scheme see www.twm.ie or (Tel: 061 305889). List of companies registered with TWM:TWM members
3. Self comply with Westmeath County Council (Tel: 044 93 32226).
Failure to comply shall result in legal action.
Waste tyres are required to be collected by authorised collector/s and sent to a licensed facility for reprocessing such as:

Individuals/companies found passing their waste on to unauthorised collectors face prosecution and could be fined up to €3,000 and or 6 months imprisonment sentence on summary conviction. If such waste is disposed of that causes environmental pollution a charge for clean up may also be charged.
How to find out if your collector is authorised:
An individual or business can apply to Offaly Co.Co. for a Waste Collection Permit for the Midland Region.
- Midland region is Longford, Westmeath, Tipperary North, Offaly and Laois.
- The permit must be carried on the vehicle at all times.
- A person can request to view the permit before giving the collector waste and check to that they are authorised for their county. The person should ensure that the waste from their site is listed in the appendix to the permit.
